1. Consent for Data Processing – Spheeti Fintech Pvt Ltd (NBFC)

1. In this Consent the following capitalized terms shall have the meanings assigned to them hereunder:
   “Data” shall mean all personal data, transactional data, Derivative Data, any other information, etc., in relation to me/us, including the following including in relation to past Products:
   (a) know your customer (KYC)/anti money laundering (AML) data;
   (b) information submitted while making any application or request to the NBFC for any Product;
   (c) any transactional data generated during the relationship or as a result of any transaction, statements, entries, logs, in relation thereto;
   (d) any information obtained/received by the NBFC from any other source;
   (e) any Derivative Data.
   
   “Derivative Data” shall mean any credit scores, credit information, behavioral projections, profiling, analytical results, reports (prepared by the NBFC internally or other persons) including through any algorithms, analytics, software, automations, profiling etc., and whether such derivative is from the information collected from me/us or in combination with any other information sourced from any other person, database, or source whether by the NBFC or other persons.
   
   “Specified Purposes” shall collectively mean credit assessment, risk analysis, credit information reports, fraud detection, crime prevention, credit worthiness evaluation, due diligence, background checks, inspections, verifications, collections, legal actions, reporting, and any regulatory obligations.
   
   “Processing” includes collection, recording, structuring, use, sharing, or destruction of Data.
   
   “Processing Entity” means any party with whom the NBFC has a contract for services including CICs, fintechs, partners, and vendors.
   
   “Product(s)” means lending services or facilities offered directly or through partners. “Requested Products” are those applied/availed by me/us. “Other Products” means any additional services.
   
   
2. I authorize Spheeti Fintech Pvt Ltd (“NBFC”) to Process the Data for Specified Purposes:
   (i) for assessment or execution of contract or application for Requested Products;
   (ii) for Derivation and sharing of Derivative Data with Processing Entities;
   (iii) for establishing communication through various channels for monitoring or fraud checks;
   (iv) for use of analytics, automation, or profiling for said purposes.
   
   
3. I authorize Processing Entities to Process Data for the Specified Purposes.
   
   
4. I confirm the accuracy of the Data shared now and in the future.
   
   
5. I agree this consent survives the termination of any Products.
   
   
6. This consent is in addition to and not in derogation of any prior or independent consent.
   
   
7. I confirm this consent is given voluntarily, without pressure.
   
   
8. I understand this Processing is necessary for product or service delivery.
   
   
9. Even upon withdrawal of consent, NBFC and its partners may continue to Process Data as required under contract or law.
   
   
10. Withdrawal of this consent will not impact Processing for services already availed or agreements executed.

2. Consent for Credit Information Access

In connection with the submission of an application to receive my credit information from Credit Information Companies (CICs) through Spheeti Fintech Pvt. Ltd. (“Agent”), I acknowledge and agree as follows:

The Agent is appointed to receive and use the Product from CICs strictly for lawful and predefined purposes. These purposes include verifying my identity, assessing my creditworthiness, determining loan eligibility, conducting risk and fraud assessments, performing regulatory reporting, and any other activity necessary for delivering financial services or fulfilling compliance obligations as per the agreement between me and the Agent.

I grant unconditional consent to the Agent to receive the Product and use it for the purposes outlined above.

I expressly authorize CICs to deliver the Product to the Agent.

I shall not hold CICs responsible for:
(a) delivery of the Product to the Agent;
(b) use/disclosure of its contents;
(c) any misuse or breach of confidentiality;
(d) any use contrary to this agreement or understanding.

I confirm CICs have made no representations to induce consent.

By submitting my consent electronically (e.g. clicking “I Accept”), I am authorizing the Agent to obtain my credit information solely for identity confirmation, eligibility assessment, and Product delivery.

By submitting the registration form, I authorize the Agent to retrieve credit reports from CICs for as long as my account remains active and to retain such data as required under its Terms of Use and Privacy Policy.

I acknowledge the Product is provided “as-is” and CICs disclaim all warranties.

I release and indemnify CICs, their affiliates, officers, and agents from any liability or losses arising from this consent and delivery of credit information.

These terms are governed by Indian law and subject to the courts in Ulhasnagar. CICs may assign rights without prior notice.
